Terms and Conditions
By accessing or using the Platform on any computer, mobile phone, tablet, laptop, console or other device (collectively, “Device”), you agree that you have read, understand and agree to be bound by these Terms and the applicable law, whether or not you are a registered member of Friday. We may change these Terms at any time without notice, effective upon its posting to the Platform.
Please be aware that the Class(es) you are purchasing may not be opened if the minimum interest is not collected.
Friday takes care in the selection, verification of ID, and production of Class(es), but we cannot guarantee that all classes are free from issues or substandard quality, including possible loss of interest.
Users that register any class on the Platform do so at their own risk. By enrolling in the class, the user and its representatives expressively releases and discharges Friday and its representatives from any and all claims, cause of action, damages, or other liability which might have arisen from or be related to the Services, to the extent permitted by applicable laws and regulations.
We may decide to cease making available certain features of the Services at any time and for any reason. Under the circumstances will Friday or its affiliates, suppliers, partners or agents be held liable for any damages due to such interruptions or lack of availability of such features.
We are not responsible for delay or failure of our performance of any of the Services caused by events beyond our reasonable control, such as an act of war, hostility, or sabotage; natural disaster; electrical, internet, or telecommunication outage; or government restrictions.
You will need to register an account to enroll in Class(es) available to you on the Platform. In registering an account you agree to provide information about yourself that is true, accurate, current, and complete in all respects. Friday reserves the right to only accept orders from you if you are aged 18 or over.
In using the Platform, you agree to accept responsibility for all activities conducted through your account. You are responsible for keeping your account and password secure. If you feel or suspect that the security of your account has been compromised or if there is unauthorised use of your account, please contact us immediately.
To register for the Class(es), you must complete the registration process and pay all required registration fees (if any) prior to any deadlines described on the registration page for the Class(es). Registrations are subject to availability and may close earlier than posted deadlines.
Prohibitions and Failure to Comply
You agree to behave in such a way as to create a safe, supportive learning environment throughout the Class(es) and any related events. You agree not to engage in disruptive speech or behavior or otherwise interfere with the Class(es) or other individuals’ participation in the Class(es). You will comply with all applicable laws and agree not to engage in any form of harassing, offensive, discriminatory or threatening speech or behavior, including relating to race, gender, sexual orientation, religion or disability.
We may take actions against your account for activities including, but not limited to:
- Using any technology to attempt to hide the use of multiple accounts or disrupt any of our Services in any way;
- Frame or embed the Services (such as to embed a free version of a class) or otherwise circumvent the Services;
- Initiating communications that contain any unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, profane, hateful, or racially, ethnically or otherwise objectionable material;
- Advertising or sending unsolicited messages of any kind; and
- Impersonating others or providing any kind of false information.
Friday reserves the right to terminate any account at its sole discretion. We may send you an email to inform you of the termination of your account in such event. If you witness such behaviour, please promptly contact a Friday staff member so direct action can be taken.
All software and Content (which is defined as, or includes, any text, audio or music, video, graphics, photographs, and image) other than created by Contributors are the intellectual property of Friday and are protected by intellectual property and copyright laws and international treaty provisions.
The Site is for your personal and non-commercial use only. Any non-personal and/or commercial use of the Content is only permitted when expressly authorised by Friday and/or its third party licensors. You may not upload, download, post, distribute, reproduce, publish, sell or license any Content contained within the Site without prior consent or authorization of Friday. Any such unauthorized actions may result in civil consequences or criminal penalties.
You agree that we are free to use, disclose, adopt and modify all and any ideas, concepts, know-how, proposals, suggestions, comments and other communications and information provided by you to us (“Feedback”) in connection with this Site without any payment to you. You hereby waive and agree to waive all and any rights and claims for any consideration, fees, royalties, charges and/or other payments in relation to our use, disclosure, adoption and/or modification of any or all of your Feedback.
Friday reserves the right to withdraw or amend any Class item of the Services without notice. We will not be liable if for any reason the Site is unavailable at any time and for any period.
Third Party Links
The Site may include links to other websites or resources that are not operated or prepared by Friday. We have no control over such sites and resources and we will not accept responsibility for them or be liable for any loss or damage caused or alleged to be caused by or in connection with your use of them.
Eligibility to Enroll in Classes
In order to enroll in classes by Creators, you must meet our conditions of eligibility:
- Be aged 18 years of age or over;
- Be in possession of a valid credit/debit card issued by a licensed bank acceptable to Friday for payment or be in possession of a valid local bank account; and
- Providing personal and payment details that are warranted by you to be both valid and accurate (email address, real name, phone number, billing information and other requested information as indicated on the Site)
All orders are subject to class availability and confirmation of the order price. Items in your shopping basket are not reserved and may be purchased by other users.
Friday will endeavour to ensure that the Content and the class descriptions on the Platform to be accurate and complete as possible. We however do not warrant that Content and service descriptions are accurate, complete, current or error-free. Please refer to our Refund policy if you feel a service offered by Friday is not as described.
The prices of courses on Friday are determined based on the terms of the Contributor Terms. In some instances, the price of a Class offered on the Friday website may not be exactly the same as the price offered on our mobile and third-party affiliated applications, due to mobile platform providers’ pricing systems and their policies around implementing sales and promotions.
We run promotions and sales for our classes and certain classes are only available at discounted prices for a set period of time. The price applicable to a course will be the price at the time you complete your purchase of the course (at checkout). Any price offered for a particular course may also be different when you are logged into your account from the price available to users who aren’t registered or logged in, because some of our promotions are available to new users only.
Prices are shown on the Site in Hong Kong Dollars (HKD). Prices displayed on the Site at the time your order is accepted will be honoured except in the case of obvious error. Whilst we use our best endeavours to ensure that all prices appearing on the Site are accurate, we do not guarantee that they are error-free and reserve our right to rectify any errors. If we discover an error in the price of any class that you have enrolled in, we will inform you as soon as possible and offer you the option of re-confirming or cancelling your order. If we are unable to contact you, we will treat the order as cancelled. If your credit/debit card is not denominated in Hong Kong Dollars (HKD), the final price charged in your currency will be calculated by your issuing bank in accordance with the applicable exchange rate on the day your card issuer processes the transaction.
When you make a purchase, you agree not to use an invalid or unauthorized payment method. If your payment method fails and you still get access to the course you are enrolling in, you agree to pay us the corresponding fees within seven (7) days of notification from us. We reserve the right to disable access to any Class(es) for which we have not received adequate payments.
By placing an order using one of the above Credit/Debit card and online payment methods, you confirm that the Credit/Debit card(s) or bank account used is yours or that you have been authorised by the owner to use it. If your card issuer refuses to authorise payment to Friday, we will not be liable for any delay or non-delivery of classes.
Our payment processes meet the stringent international security standards set down by the Payment Card Industry to make your shopping experience safe and secure. If you have registered an account on the Site and have decided to save your card details with us, your details will be fully encrypted, solely used to process card transactions that you have initiated and securely stored on our systems. In the absence of negligence on our part, we will not be liable for any loss you may suffer if any third party procures unauthorised access to any data you provide when using our Services.
Acceptance of your Order
Once you have entered your personal and payment details and placed your order, we shall send you an email acknowledging the receipt of your order. This email is only a confirmation of receipt of your order and does not constitute an acceptance of your order. Your order will be accepted and the contract between you and Friday will be completed when we send you an email to confirm your payment has been received. Only the classes listed in the confirmation email sent at the time of dispatch are included in the contract formed. All sales contracts are therefore concluded in Hong Kong SAR and are written in English.
Friday reserves its right not to accept an order for any reason at its sole discretion. Such reasons include, but are not limited to, one of the following:
- The Class you ordered is out of stock, or is withdrawn due to its failure to meet our quality standards or due to unknown reasons;
- We identify a pricing or class description error;
- We are unable to obtain authorisation for payment; and
- You do not meet the eligibility criteria to purchase as set out in these terms.
Our Customer Service team will contact you as soon as possible if there are any problems with your order.
If not otherwise stated, refunds are allowed within 72 hours of payment; and
100% refund for online class within 3 days after access grant date
100% refund for materials within 3 days after purchase order and before order cut-off date
No refund is allowed after the above period or the order cut-off date, whichever the earliest.
Users that enroll in classes do so at their own risk. By enrolling in the classes, the user and its representatives expressly releases and discharges Friday and its representatives from any and all claims, cause of action, damages, or other liability which might have arisen from or be related to the enrolled classes, to the extent permitted by applicable laws and regulations.
At our discretion, if we believe you are abusing our refund policy, we reserve the right to ban your account and to restrict all future use of the Services. If we ban your account or disable your access to a course due to your violation of these Terms, you will not be eligible to receive any refund.
Friday do not review or edit Classes for legal issues, and we are not in a position to determine the legality of the course content. We do not exercise any editorial control over the courses that are available on the platform and, as such, do not guarantee in any manner the reliability, validity, accuracy or truthfulness of the courses. If you enroll in a course, you rely on any information provided by an instructor at your own risk.
By using the Services, you may be exposed to content that you consider offensive, indecent, or objectionable. Friday has no responsibility to keep such content from you and no liability for your access or enrollment in any Class(es), to the extent permissible under applicable law.
When you use our Services, you will find links to other websites that we don’t own or control. We are not responsible for the content or any other aspect of these third-party sites, including their collection of information about you. You should also read their terms and conditions and privacy policies.
Views expressed in any media by the designers, companies or third parties, whose classes are offered on the Platform or with whom we are associated, are their own. Friday takes no responsibility for any such views as they do not necessarily reflect ours.
Friday does not guarantee that the use of the Platform and Services will be error-free or that the Platform or the servers that make it available are free of viruses or other harmful components. We recommend all users of the Site to ensure they have up-to-date software, including anti-virus, installed.
Indemnity and Waiver
At our request, you agree to compensate us fully and hold us, Friday (including its officers, directors, agents, affiliates, licensors, and suppliers), harmless from and against all liabilities, claims, expenses, damages and losses, (including reasonable attorney fees) arising from (a) the content you post or submit, (b) your use of the Services (c) your violation of these Terms, or (d) your violation of any rights of a third party. This includes the use of the Site by any other persons using your account caused by your action or inaction.
If you breach these Terms and we take no action against you, it is no waiver for us to exercise our rights and remedies in any other situation where you breach these Terms. Your indemnification obligation will survive the termination of these Terms and your use of the Services.
We have our complaints handling procedure that we will use to try to resolve any disputes when they first arise. Please contact https://fridayoz.channel.io/ for any order related complaints or comments.
Friday respects the intellectual property of others. If you have reason to believe your work may have been used in the Site without your permission, please contact us following this complaints handling procedure.
Third Party Rights
The parties do not intend that any term of these Terms should be enforceable, by virtue of the Contracts (Rights of Third Parties) Ordinance (Cap. 623 of the Laws of Hong Kong), by any person who is not a party to these Terms, except any affiliates of Friday Company Limited.
Governing Law and Jurisdiction
These terms, together with all our policies and procedures, are governed by and construed in accordance with Hong Kong SAR law. If a dispute does arise, both parties consent to the exclusive jurisdiction and venue of the courts located in Hong Kong SAR.
